1. OVERVIEW OF HOPE AFFIRM THRIVE
1.1. Hope Affirm Thrive is an online coaching program focused on education, advocacy, and emotional wellbeing for first-time consumers of infertility treatments who do not require one-to-one psychological support from an in clinic or private practice fertility counsellor. The service is aimed at women navigating the complexities of fertility treatments but who are not in need of clinical psychological services.
1.2. Participation in the pilot version of the program is free; however, participants acknowledge that it is a pilot and agree to provide weekly feedback about the program in exchange for their participation as directed by us.
1.3. It is essential that potential participants confirm their suitability for the program in writing, particularly if they have pre-existing mental or physical health conditions, which may make participation unsuitable. We advise that individuals with such conditions consult their healthcare providers before participating.
1.4. The program was designed to provide high-quality, evidence-based content to married, single, and career-driven women in their mid 20s to late 40s. It specifically caters to women seeking emotional support and advocacy skills while undergoing infertility treatments.
2. STRUCTURE OF THE PROGRAM
2.1. We operate as an online coaching program, comprising 4 modules and 1 full day workshop delivered over an 8-week time period. The modules are designed to guide participants through emotional resilience, advocacy skills, and well-being strategies for navigating infertility treatments. The program consists of pre-recorded video sessions, live webinars, and interactive group coaching sessions.
2.2. All program content will be delivered via an online platform, accessible through our secure website. Participants will be able to download course materials and access recordings of live sessions for a limited period post-session.
2.3. Participants can schedule private one-on-one coaching sessions with Elizabeth Bancroft (the Coach) upon request, which are separate from the core program. These sessions will be tailored to each participant’s specific needs, but they do not constitute psychological therapy.
3. RELATIONSHIP WITH HOPE AFFIRM THRIVE
3.1. The Program is strictly a non-clinical service designed to provide coaching and educational support. It is not a substitute for psychological counselling or medical treatment. Participants acknowledge that, although Elizabeth Bancroft is a registered clinical and counselling psychologist, they are not receiving psychological services as part of this program and the program is not a psychological service.
3.2. By consenting to participate in the program, participants acknowledge that they are participating in a coaching program and are not receiving psychological services from the Coach.
3.3. To avoid any potential conflicts of interest arising, the Coach’s active clients cannot be accepted as participants in the program within two years of cessation of psychological services provided by the Coach in writing.
3.4. Similarly, participants in the program cannot be accepted as the Coach’s active clients within a minimum of two years of completion of the program.
3.5. Any requests for cross-referral or registration between the Coach’s former clients and the program will be assessed on a case-by-case basis, and will only be accepted at the Coach’s discretion, depending on the individual circumstances.
3.6. If, during the course of the program, it becomes evident that a participant requires services outside the scope of this coaching program, the Coach may terminate the program and recommend they seek a referral to a healthcare professional or psychologist.
3.7. We reserve the right to terminate a participant’s involvement in the program if it is deemed inappropriate for them to continue, based on concerns for their well-being or suitability. In such cases, the participant may be eligible for a partial refund based on the circumstances
4. TECHNOLOGY REQUIREMENTS [WHERE SERVICE IS PROVIDED ONLINE]
4.1. The program is provided online through our website portal and by videoconferencing. You are responsible for the costs associated with setting up the technology needed so you can access online content and participate in video conferencing workshops.
4.2. To access the program content, you will need access to a computer, video camera, speakers and a private room or quiet space.
4.3. Online communication privacy may be vulnerable and limited by the security of the technology used.
5. INTELLECTUAL PROPERTY
5.1. All content provided within our website is the intellectual property of Hope Affirm Thrive.
5.2. Any reproduction, redistribution, or use of the visual, auditory, or written content from Hope Affirm Thrive without permission is strictly prohibited. This includes sharing course materials with non-participants.
6. FEES
6.1. The program fees are clearly outlined during the registration process and are payable before commencing the program.
7. CANCELLATION & REFUND POLICY
7.1. Participants are entitled to a full refund if they cancel their registration at least 72 hours before the program begins. After this period, refunds will only be granted in exceptional circumstances and at the discretion of the program.
7.2. After the program begins, a full or partial refund will be granted only if the participant’s registration is terminated by us.
8. PRIVACY POLICY
8.1. We are committed to safeguarding the privacy of our clients, staff, and visitors, as well as those who visit our website. All personal and sensitive information collected as part of your participation in the program is handled in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and other relevant laws governing how health service providers handle your personal and sensitive information (including information about your health), including mental and physical health details.
8.2. To provide our services, we may collect and store both personal information and sensitive information. This may include the following:
(a) personal details (name, phone number, address, email address, etc);
(b) payment and billing information (to process payments for services);
(c) health information (physical and mental health details, including injuries or pregnancy);
(d) personal and family history;
(e) sensitive information, which may include data about your race, religion, political beliefs, sexual orientation, criminal record, or health conditions; and
(f) other information voluntarily provided by you.
8.3. Your data is collected to ensure your safety and well-being, and that of other participants, and to provide updates or process purchases related to services offered by us.

8.4. Personal information will be used only for the purposes for which it was collected, such as maintaining contact details, processing payments, and delivering program services.
8.5. We also may use your personal information to provide updates on services, opportunities, or products.
8.6. Sensitive information will only be collected, used, or disclosed with your explicit consent and will be managed in compliance with applicable legal obligations.

8.7. Personal information may be shared with third parties, such as healthcare providers, professional advisers, or law enforcement agencies, as required to comply with legal obligations, or for research purposes.

Consent to Collection and Use
8.12. By participating in the program, you acknowledge and consent to the collection, use, and disclosure of your personal information.
8.13. You must review and acknowledge your understanding of this policy before commencing the program.
9. WAIVER
9.1. Assumption of Risk: Our program is a non-clinical service. Participants may engage in exercises or activities designed to promote emotional well-being and advocacy skills. Although these activities do not involve physical exertion, some participants may experience emotional or mental strain. It is important that participants assess their own mental and physical health before starting the program. We urge consulting with a healthcare provider if you have any concerns regarding your participation.
9.2. Discontinuation of Activities: If, at any time during the program, you experience any discomfort, emotional distress, or mental strain, you should immediately discontinue the activity and inform us. Our program includes elements such as reflective exercises, journaling, and group discussions, which may evoke emotional responses.
9.3. No Substitute for Medical or Psychological Treatment: Our program is not a substitute for psychological counselling, therapy, medical examination, diagnosis, or treatment. The program does not offer therapeutic services, and participants who feel they require such services should seek appropriate professional care. Participants with existing medical or psychological conditions should consult with their healthcare provider before joining this program.
9.4. Release of Liability: By participating in our program, participants acknowledge that they assume full responsibility for their involvement. Participation is voluntary and at the participant's own risk. We will not be held liable for any emotional distress or other discomfort experienced during or after participation.
9.5. Informing of Health Conditions: Participants agree to inform the Program Provider of any pre-existing mental or physical health conditions, including but not limited to, pregnancy or a history of mental health concerns, that may impact their ability to participate in the program safely.
9.6. Property and Personal Safety: Participants are responsible for their own personal safety and for safeguarding their personal belongings during the course of the program. We accept no responsibility for any loss or damage to personal property during participation in the program.
9.7. Indemnity: By signing this waiver, participants agree to release the Program Provider, its staff, and affiliates from any claims, including negligence, that may arise from their participation in our program. Participants are encouraged to seek independent legal advice if they have concerns about any risks associated with the program.
9.8. EMDR and Related Strategies: Participants may engage in techniques such as self-administered EMDR (Eye Movement Desensitisation and Reprocessing), which includes strategies such as butterfly taps, bilateral eye movements, and progressive muscle relaxation. These techniques may not be suitable for all participants, particularly those with pre-existing cardiac, respiratory, neurological, or psychological conditions. We advise consulting with your healthcare provider before participating in these activities.
9.9. Assumption of Risk for EMDR Activities: Participants acknowledge that engaging in self-administered EMDR may involve certain emotional, mental, or physical risks, including but not limited to emotional distress, flashbacks, or physical discomfort. By participating, participants assume full responsibility for any risks associated with these activities.
9.10. Movement Waiver: Participants must disclose any health conditions that may affect their ability to safely participate in movement-based strategies such as butterfly taps, bilateral eye movements, or other relaxation techniques. Conditions that may require special consideration include, but are not limited to, heart conditions, respiratory issues, epilepsy, and mental health concerns. By signing this Terms & Conditions, Privacy Policy and Waiver, participants confirm they have consulted with a healthcare provider, if necessary, and are fit to engage in these activities.
10. CONSENT TO PARTICIPATION IN THE HOPE AFFIRM THRIVE PROGRAM
10.1. By signing below, I acknowledge that I understand and agree to the terms of participation in the program. I am aware that this is a coaching service, not a psychological service, and I will not receive psychological therapy during my participation.
10.2. I understand that this document is subject to change and may be modified and updated, in our sole discretion and all amendments will be effective immediately upon our posting on our website, or through distribution by email, social media platforms or other means of communication from time to time without prior notice.
10.3. I have read and understood the Terms & Conditions, Privacy Policy and Waiver and have discussed any outstanding questions with the program provider.
10.4. I understand and agree that Hope Affirm Thrive may take photographs or record any of the training sessions. I give Hope Affirm Thrive permission to capture images and recordings of me during these sessions. I also allow Hope Affirm Thrive to use, publish, and license these photographs and recordings for any purpose related to its business.
11. DISPUTE RESOLUTION
11.1. These Terms & Conditions, Privacy Policy and Waiver are governed by the laws of Western Australia. Any dispute or claim (the Dispute) shall be governed and will be interpreted and construed under the laws of Western Australia, without reference to conflict of law principles.
11.2. If a Dispute arises, neither party may commence any Tribunal or Court proceedings until the following steps have been complied with.
Notice
11.3. A party claiming a dispute has arisen under the document, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.
Resolution
11.4. Upon receiving that notice (the Notice), the parties must:
(a) Within 14 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or other mutually agreed means;
(b) If the Dispute, for whatever reasons, is unresolved after 14 days, agree on a mediator or request one from the President of the Law Society of Western Australia;
(c) The parties share equally in the mediator's fees and venue costs, while each party covers its own mediation expenses; and
(d) The mediation will be held in the nearest and most reasonably convenient location to the parties. We will make reasonable efforts to mediate, but if we fail, we will not be liable for the outcome.
Confidential
11.5. All communications regarding negotiations are confidential and should be treated as "without prejudice" under applicable laws.
Termination of Mediation
11.6. If three months pass without resolving the dispute, either party may request the mediator to terminate the mediation.
